These terms govern your use of this site, the Almanac, and the Climate Reading. By using any of them, you agree to these terms. If you do not agree, do not use the site.
We may update these terms. Material changes will be sent by email to subscribers, and the date above will change. Using the site after a change means you accept the new terms.
Not Investment Advice
This is the important one, so read it.
17 Years is a publication, not an investment adviser, and that is a choice rather than a loophole. Everything here is general information and education, published the same way for everyone. Nothing on this site is personal financial advice, a recommendation to buy or sell anything, or guidance tailored to your situation. Using the site does not create an advisory, fiduciary, broker, or client relationship of any kind.
The Climate Reading, the Owner's Yield, the allocation framework, and the essays describe a method. They are not instructions for you. We never see your accounts, never hold your money, and never place a trade. Markets carry real risk, the past guarantees nothing, and you can lose money following any approach, including this one.
Before you act on anything you read here, do your own research and consider speaking with a licensed financial adviser, and with a tax or legal professional about your own circumstances. Every decision you make with your money is yours alone, and you are solely responsible for it. Read us, argue with us, and make your own call.
Acceptable Use
This site is for adults. Read it, share links to it, and use it for your own purposes. Do not scrape it, do not access it through automated means, do not try to extract its source data or the workings of the Climate Reading, and do not interfere with anyone else's use of it. We may block access that breaks these rules.
There are no user accounts in this version of the site. Your only relationship with us is the email list, which you control: every message carries a one-click unsubscribe.
Intellectual Property
The code, the design, the instrument, the Climate Reading and its underlying method, the Owner's Yield measure, the essays, and everything else here are ours and are protected by copyright and other law. Do not copy, modify, reverse engineer, redistribute, or commercially exploit any part of it without our written permission.
You may link to and quote our essays freely, with attribution. Reproducing a full essay elsewhere requires written permission. The Climate Reading and its methodology are proprietary; you may reference and cite them, but not republish the underlying computation as your own.
Disclaimer of Warranties
The site is provided as is and as available, without warranty of any kind, express or implied. We do not warrant that it will be uninterrupted, error free, accurate, or that any financial or other outcome will follow from using it. We disclaim the implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent the law allows.
Limitation of Liability
To the fullest extent the law allows, we are not liable for any indirect, incidental, consequential, special, or punitive damages arising from your use of the site, and that includes investment losses. Our total liability to you for any claim is limited to what you have paid us, or fifty Canadian dollars, whichever is greater. This version of the site is free, so for most readers that figure is fifty dollars.
Indemnification
You agree to hold us harmless from any claim, demand, or expense, including reasonable legal fees, arising from your misuse of the site, your breach of these terms, or your violation of anyone else's rights.
Dispute Resolution
If a dispute arises, we will first try to settle it informally by email. If we cannot within 60 days, it will be resolved by binding arbitration under the rules of the ADR Institute of Canada, in English, before a single arbitrator, held in Yellowknife, Northwest Territories, or by video at the arbitrator's discretion. You agree to bring disputes individually and waive any right to a class action or representative proceeding. This clause does not stop either side from seeking a court injunction to protect intellectual property.
Governing Law
These terms are governed by the laws of the Northwest Territories and the federal laws of Canada that apply there, without regard to conflict-of-laws rules. Subject to the arbitration clause, any court proceedings will take place in the courts of the Northwest Territories.
Severability, Waiver, Entire Agreement
If any provision is found unenforceable, the rest stand, and that provision is narrowed only as far as needed to make it enforceable. Our not enforcing a right is not a waiver of it. These terms, with our Privacy Policy at /privacy and Cookie Policy at /cookies, are the entire agreement between you and us about the site.
